Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Talkscope mobile application and the talkscope.app website (together, the "Service"), provided by Talkscope ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You represent that you are not barred from using it under applicable law.
2. License to use the Service
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Talkscope app on devices you control and to access the Service for your own interview-practice purposes. The Service may be offered on a free or subscription basis; paid features are governed by the pricing and billing terms shown at purchase, and [subscription, trial, and refund terms TBD before launch]. Purchases made through the Apple App Store or Google Play are also subject to those platforms' terms.
3. Acceptable use
You agree not to:
- Use the Service unlawfully, or to record or transmit unlawful content;
- Upload or practice content that infringes others' rights or is harassing, hateful, or abusive;
- Reverse engineer, decompile, or attempt to extract source code from the Service, except as permitted by law;
- Resell, sublicense, or provide the Service to third parties as a standalone service, or scrape or abuse our APIs;
- Interfere with the Service's security, integrity, or availability, or circumvent usage limits;
- Impersonate any person or entity, or misrepresent your affiliation with Talkscope.
4. Your content
Recordings, transcripts, and notes you create with the Service are your content ("Your Content"). You retain all rights to Your Content. You grant us a limited license to process, store, and transmit Your Content solely to provide the Service to you (for example, sending audio to transcription providers to generate feedback) and as described in our Privacy Policy. You are responsible for having the rights and permissions needed for the content you record.
5. Our intellectual property
The Service — including software, design, the Talkscope name and logo, feedback rubrics, and aggregated analytics outputs we generate — is owned by us or our licensors and protected by copyright, trademark, and other laws. Nothing in these Terms transfers ownership of any intellectual property to you.
6. AI feedback disclaimer
Talkscope uses automated speech analysis and AI models to generate transcripts and feedback. Feedback is provided for general practice and educational purposes only. It is not professional career counseling, recruiting advice, legal advice, or psychological advice, and it may be inaccurate or incomplete. No advisor-client relationship is created. Interview outcomes depend on many factors outside the Service, and you should use your own judgment — and qualified professionals where appropriate — for career decisions.
7. Availability and changes to the Service
The Service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features (including while the app is in active development) without prior notice. We are not liable for availability of the Service or for on-device storage limits.
8. Disclaimers
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that transcripts, metrics, or feedback will be accurate.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of or inability to use the Service. Our total aggregate liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim arising, or [fixed USD amount TBD with counsel]. Some jurisdictions do not allow certain limitations, so they may not apply to you.
10. Indemnity
You agree to defend and indemnify Talkscope against claims arising from your unlawful use of the Service, your violation of these Terms, or Your Content, to the extent permitted by applicable law.
11. Termination
You may stop using the Service and delete your account at any time (see the Privacy Policy for data deletion). We may suspend or terminate your access if you materially breach these Terms, if required by law, or for abuse or security reasons. On termination, your license ends; provisions that by their nature should survive (disclaimers, liability limits, ownership) do so.
12. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will give reasonable notice in-app or by email where we have your address. Continuing to use the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION TBD — to be confirmed with counsel], excluding conflict-of-law rules, without prejudice to mandatory consumer protections in your country of residence.
